Apple sues HTC

Alleged orchard thieves fingered.

The fiercely proprietary cappucchino company Apple has filed a lawsuit against HTC for allegedly infringing twenty of its patents.

The patents relate to the Iphone's user interface, hardware and architecture. The lawsuit was filed simultaneously with the US International Trade Commission (ITC) and in US District Court.

Steve Jobs adopted his most Bond villain-like pose and said, "We can sit by and watch competitors steal our patented inventions, or we can do something about it. We've decided to do something about it. We think competition is healthy, but competitors should create their own original technology, not steal ours."

Ring any bells? Well it isn't far from the statement released by the firm in December when it countersued Nokia over similar patent claims. "Other companies must compete with us by inventing their own technologies, not just by stealing ours," said Bruce Sewell, Apple's general counsel and senior vice president. Let's just hope that Sewell does not sue Jobs for plagiarism.

In a statement HTC countered, "HTC is a mobile technology innovator and patent holder that has been very focused over the past 13 years on creating many of the most innovative smartphones. HTC values patent rights and their enforcement but is also committed to defending its own technology innovations. HTC only learned of Apple's actions this morning via media reports, and therefore we have not yet had the opportunity to investigate the filings. Until we have had this opportunity, we are unable to comment on the validity of the claims being made against HTC."

Just because HTC released a phone which is superior to the iPhone, Apple get on there patent high horse. We didn't see that one coming now - did we?

I know this would be only one of the patents but didn't Google distribute Multi-touch to the HTC handsets. So it's Google they should be after?

HTC also does the windows mobiles which have multi-touch, and software support for multi-touch is useless unless the hardware is capable.. so yeh HTC.
to me it sounds like apple grasping at market share straws cause they know they're going to get killed in the next 12 months by a dozen or so FAR superior handsets!

I am under the impression that you can not patent multi-touch as it is a general concept as opposed to filing a patent for how you make the concept a reality.

I would think apple is suing HTC over how they implemented multi-touch

HTC make better phones than Apple, so it's no surprise. It's the OS that makes the iPhone/Touch popular.

Apple are just doing their thing, i.e. being control freaks. They didn't stand a chance against Google, so they go for the little guy. Perhaps I'm being a bit presumptuous, but it's looking like Apple are picking up where Microsoft left off.

What, excactly, are they suing over?

Knowing the ridiculous things that can be patented, I'm hoping most of 'em just get thrown out straight away

thesorehead, even if they don't get thrown out, I'm sure HTC will countersue. They've been in the handset business for a lot longer, and there's a good chance Apple has infringed patents too.

I suspect this will end with a settlement. Why? Apple aren't necessarily looking for money or loss of competition out of this, they want to protect their patents so they can enforce them when they're losing to the likes of Google or Microsoft. If they let people infringe their patents now, the courts will ask why they didn't act earlier.

Apple know how to play their hand, too bad the end consumer loses out. I mean, look at the patents, most of them are quite broad.

If Apple does get their way, it'll mean no HTC phones will be imported into the US. That'll buy Apple time to update their now stale OS. Android and Windows Phone 7 are starting to overtake the quality bar set by Apple, and they don't like that one bit.
